1) Terms of business

Foundations21 is supplied under the terms of the BRF Terms and Conditions, which can be found on the BRF website, www.brf.org.uk. The same terms apply to the purchase of any other BRF products advertised on Foundations21.

2) Copyright

All material included on this site, including but not limited to graphics, logos, icons, text and software, is copyright ©2004 - 2010 The Bible Reading Fellowship or its content providers including images which are licensed from Photos.com, and is protected by UK and international copyright laws. The Bible Reading Fellowship grants you the right to use this website for your personal use. This licence does not include any resale or commercial use or derivative use of the website or its contents.

3) Disclaimer and liability

a) This website is provided by The Bible Reading Fellowship on an 'as is' basis. We make no representations or warranties of any kind express or implied as to the operation of this site or the information content materials or products included on this site. You agree that your use of this site is at your sole risk.

b) Except as specifically stated on the website, to the full extent permissible by applicable law The Bible Reading Fellowship disclaims all warranties express or implied including but not limited to implied warranties of satisfactory quality or fitness for a particular purpose. This does not affect your statutory rights as a consumer.

c) The Bible Reading Fellowship does not warrant that this website, its servers or e-mail sent from The Bible Reading Fellowship are free from viruses or other harmful components.

d) The Bible Reading Fellowship will not be liable for any damages of any kind arising from the use of this website including but not limited to damages for consequential loss where such losses were not foreseeable to both parties when the Contract was made or where such losses were not caused by any breach by The Bible Reading Fellowship. The Bible Reading Fellowship excludes liability for any losses to parties who are not dealing as consumers including but not limited to loss of profit, business or economic loss.

e) These exclusions of liability will not apply to any damages arising from death or personal injury caused by the negligence of The Bible Reading Fellowship or any of its employees or agents.

4) General

a) If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of this Agreement and the remainder of the provision in question shall not be affected thereby.

b) Failure or neglect by The Bible Reading Fellowship to enforce at any time any of the provisions of these Terms and Conditions shall not be construed nor shall be deemed to be a waiver of its rights under these Terms and Conditions nor in any way affect the validity of the whole or any part of these Terms and Conditions nor prejudice The Bible Reading Fellowship's rights to take subsequent action.

THIS DOES NOT AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER.

5) Monitoring

We have no obligation to monitor Websites we link to, chats, message boards or any other materials that you or third parties transmit or post on or to the Site. However, you acknowledge and agree that we have the right (but not the obligation) to monitor the Foundations21 site, message boards, the chats and the materials you transmit or post; to alter or remove any such materials (including, without limitation, any posting to a chat or message board); and to disclose such materials and the circumstances surrounding their transmission to any third party in order to operate the Foundations21 site properly; to protect ourselves, our sponsors, and our members and visitors; and to comply with legal obligations or governmental requests. Members are expected to abide by the Community Rules that are set below. Any member failing to comply with the Community Rules may be expelled from message boards, chats or other public forums on the Site. BRF may terminate or restrict such member's continued access to the Foundations21 site.

6) Community Rules

You agree to comply with the Community Rules when using the Foundations21 chat rooms and message boards. • Contributions must be civil, tasteful, constructive and polite, not mean-spirited or intended to cause trouble.

• No disruptive, offensive or abusive behaviour.

• No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.

• Be patient: users of varying abilities (and ages) may be taking part in the community.

• No spamming or off-topic material: submission of the same or very similar contributions many times is not allowed. Please do not re-submit your contribution to more than one discussion, or contribute off-topic material in subject-specific areas.

• No advertising

• No impersonation

• No inappropriate (e.g. vulgar, offensive) usernames

7) Your username and password

As part of the registration process, you will be asked to select a username and password. We may refuse to grant you a username or password that impersonates someone else, is or may be illegal, is or may be protected by trademark or other proprietary rights law, is already in current use, is vulgar or otherwise offensive, may cause confusion, or for any other reason as determined by us in our sole discretion.

You are responsible for ensuring the confidentiality of your username and password, and you agree not to transfer or resell your use of or access to the Foundations21 site to any third party. If you have reason to believe that your account is no longer secure, you must promptly change your password in My Details, Personal Details, Change Password. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR USERNAME AND PASSWORD AND FOR ANY AND ALL ACTIVITIES, WHETHER BY YOU OR ANYONE ELSE (INCLUDING WITHOUT LIMITATION PURCHASES) THAT ARE CONDUCTED THROUGH YOUR ACCOUNT.

8) Disclaimer regarding links to other websites

Foundations21 may provide links to other Internet websites or resources ('Linked Sites'). The Bible Reading Fellowship does not control such Linked Sites, nor have we reviewed or approved any content that appears on such Linked Sites. You acknowledge and agree that The Bible Reading Fellowship is not responsible for the legality, accuracy or inappropriate nature of any content, advertising, products or other materials on or available from any Linked Sites. You further acknowledge and agree that The Bible Reading Fellowship shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods and services available on or through any Linked Site.

9) Right to amend the Foundations21 website and the Terms and Conditions

The Bible Reading Fellowship reserves the right at any time to modify the content, presentation, performance, user facilities and availability of any part of the site temporarily or permanently without notice to you and will not be liable to you for any modification of the site.

We also reserve the right to modify these Terms and Conditions without reference to you.

10) Right to withdraw the Foundations21 website temporarily

Whilst The Bible Reading Fellowship makes every effort to ensure that the Foundations21 site is available, we take the right to withdraw the site temporarily without notice to you and we will not be liable to you in any way for a temporary withdrawal of the site.

11) Loss of your personal data

Whilst The Bible Reading Fellowship makes every effort to ensure that the personal information you save on the Foundations21 site is kept saved as long as your registration lasts, we will not be liable to you in any way for loss of any data.

12) Interfering with the Foundations21 site

You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Foundations21 site or to alter or to attempt to alter its content.

13) Privacy Policy

The personal details you submit will be treated with the utmost care and respect. The Bible Reading Fellowship will not divulge this information to anyone else. We will only use your e-mail address or postal address to send you information about Foundations21.

What Personal Information does The Bible Reading Fellowship collect about you?

The types of information we gather include:

• We receive and store information you enter in your Personal Details and in any feedback you send to us. We use this information for such purposes as responding to your requests, improving our provision of resources and communicating with you.

• Information you save in My Journal, Faithline, My Community, Notepad, Mentor Details, My Gospel Learning Style and Community Details is all stored on our server but will not be accessed by anyone else other than you in this personal form. We do, however, reserve the right to be able to access the material that may be made to these sites, without informing any user that we are so doing, but this is never linked to your personal details. This will be purely for the purposes of monitoring overall performance and use, in order to improve the service offered by Foundations21. NO INDIVIDUAL MESSAGES, PERSONAL DATA OR PRIVATE MATERIAL WILL BE VIEWED, READ, STORED OR TRANSMITTED BY ANYONE CONNECTED WITH THE DELIVERY OF FOUNDATIONS21. ANY DATA COLLECTED FROM THE SITE SERVER WILL BE ENTIRELY ANONYMOUS AND WILL ONLY BE ABLE TO BE USED IN AGGREGATED FORM.

• Do we share your personal information?

We do not share any information we collect about you. We share customer information only with our agents such as our distributors and associated businesses (see below).

Agents: We employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analysing data, providing marketing assistance, processing credit card payments, and providing customer service. They have access to personal information needed to perform their functions, but may not use it for other purposes.

E-mailing Mentors/group members/friends

You are consenting for some information about your progress and opinions to be sent by electronic mail to the Mentors/group members/friends of your choice. The Bible Reading Fellowship is not liable for any delivery errors caused by the system or the user, nor does it take responsibility for any of the content of said electronic mail

Disclosure of your information

We may disclose information in special cases when we have reason to believe that disclosing this information is:

• reasonably necessary to comply with the law

• to enforce or apply our Terms and Conditions

• to protect our rights and those of our users

The content of other sites linked to the Foundations21 site is not covered by this privacy policy. These other sites will have separate privacy and data collection practices. We do not have responsibility or liability for these independent policies. Links to other sites are provided by us for information only and in good faith. We are not responsible or liable for any content advertisement, product or other materials on or available from such sites.

How secure is my personal information?

• Whilst The Bible Reading Fellowship makes every reasonable effort to protect the data you save on the site, it will not be liable for any security failures. All personal data and information submitted to the system is at the users own risk.

• You should protect against unauthorised access to your own computer. It is important to sign off when you finish using a shared computer.

Underage users

Underage users agree to get consent from their guardians before submitting any personal information on the site.

Can I access any personal information you hold about me?

You can access all the personal details we hold about you. These are saved in My Journal, Faithline, My Community, My Gospel Learning Style and My Details.

14) Applicable law

The Contract and these Terms and Conditions shall be subject to English law and the parties submit to the non-exclusive jurisdiction of the English Courts.
